(b) if both the Speaker and Deputy Speaker are unavailable—be given to the clerk of the Legislative Assembly.

(2) For subsection (1), the Speaker or Deputy Speaker is unavailable if—

(a) he or she is absent from duty; or

(b) there is a vacancy in the office.
