Clause 5 (3)

Page 4, line 13—

omit clause 5 (3), substitute

(3) An approval is a disallowable instrument.

Note A disallowable instrument must be notified, and presented to the Legislative Assembly, under the Legislation Act.

(4) Subject to any disallowance or amendment under the Legislation Act, chapter 7, the approval commences—

(a) if a motion to disallow the approval is moved in the Legislative Assembly and the motion is negatived—the day after the day the motion is negatived; or

(b) the day after the 6th sitting day after the day it is presented to the Legislative Assembly under that chapter; or

(c) if the approval provides for a later date or time of commencement—on that date or at that time.

Page 4, line 21—

insert

(2A) Subject to any disallowance or amendment under the Legislation Act, chapter 7, the declaration commences—

(a) if a motion to disallow the declaration is moved in the Legislative Assembly and the motion is negatived—the day after the day the motion is negatived; or

(b) the day after the 6th sitting day after the day the declaration is presented to the Legislative Assembly under that chapter; or

(c) if the declaration provides for a later date or time of commencement—on that date or at that time.
