Proposed new paragraph (1) (ba)

After paragraph (b), insert the following new paragraph:(ba) the court is satisfied that it is no longer appropriate that the relevant sentence, or part of the sentence, of imprisonment or remand be served by way of home detention because the continuation of the home detention order may cause harm (including mental harm to anyone; or

Subclause (2)
Page 17, line 25-
Omit the subclause, substitute the following subclauses:(2) Subsection (1) (c) applies despite any continuing consent under section 11 (1) (c) of any person to the making of the order.
(3) This section does not limit the relevant court's powers in relation to the person.
